Liability Waiver and Release of Legal Responsibility
By booking The Agave Experience (whether directly through our website or via any third-party platform such as TripAdvisor, GetYourGuide, or others), you acknowledge and agree to the following terms and conditions:
1. Assumption of Risk
Participation in any tour, activity, or experience organized by The Agave Experience involves inherent risks, including but not limited to accidents, injuries, illnesses, theft, property damage, or other unforeseen events. By booking, you voluntarily assume all such risks and agree to participate at your own responsibility.
2. Release of Liability
The Agave Experience, its owners, employees, partners, and affiliates will not be held liable for any accident, injury, loss, theft, damage, illness, delay, or expense of any kind that may occur during or as a result of participating in our tours or activities.
3. Personal Responsibility
Each participant is solely responsible for their own safety, well-being, and personal belongings during the tour. We strongly recommend having valid travel insurance that covers medical expenses, personal injury, and loss or theft of belongings.
4. Alcohol Consumption
Alcoholic beverages may be offered during the tour. Participants must be of legal drinking age (18 or 21 years old, depending on local law). By participating, you acknowledge that consumption is at your own risk and responsibility. The Agave Experience is not responsible for any consequences arising from alcohol consumption during or after the tour.
5. Medical Conditions
Each participant is responsible for informing us of any medical condition that may affect their ability to safely participate in the tour. The Agave Experience assumes no responsibility for health problems, complications, or incidents that occur during the activity.
6. Right to Refuse Service
We reserve the right to deny participation to anyone who appears to be intoxicated, disruptive, or poses a risk to themselves or others. In such cases, no refund will be provided.
7. Transportation
If transportation is provided by The Agave Experience, we are not responsible for accidents, delays, road conditions, or incidents that may occur during transit.
8. Force Majeure
The Agave Experience is not responsible for cancellations, delays, or modifications caused by circumstances beyond our control, including but not limited to weather conditions, natural disasters, strikes, government actions, or other force majeure events.
9. Cancellation and Modification Policy
All reservations are non-refundable and cannot be modified within 24 hours of the scheduled tour. Cancellations made less than 24 hours before the tour will not be eligible for a refund or rescheduling under any circumstances.
10. Third-Party Bookings
Whether your reservation is made directly on our website or through an external platform (TripAdvisor, GetYourGuide, or others), these terms and conditions equally apply and are binding upon confirmation of your booking.
11. Governing Law and Jurisdiction
Any dispute arising from participation in our tours will be governed by and interpreted in accordance with the laws of Mexico, with exclusive jurisdiction in the courts of Jalisco.
12. Acceptance of Terms
By completing your reservation, you confirm that you have read, understood, and accepted this Liability Waiver and Release of Legal Responsibility and that you are participating voluntarily and at your own risk. In all cases, completing a reservation will be considered sufficient proof that you have read and accepted these terms, even if you have not physically signed this document.
